Acceptable Use Policy
The information contained in this Acceptable Use Policy (this “Policy”) refers to the ClickDimensions marketing automation solution. This Policy is incorporated by reference into the ClickDimensions Terms of Service and all users of the automation solution must comply with this Policy at all times. Any user that violates this Policy may have their account suspended or terminated. ClickDimensions may update this Policy as it deems necessary from time to time and will notify users of the ClickDimensions’ services of any such updates via this website.
- The Service may only be used for lawful purposes.
- The Service may not be used for hosting content, including images and documents, that infringe on the intellectual property rights of others, including copyright, trademark and patent infringement, or that include any obscene or libelous material or other material that violates any applicable law or regulation.
The Service may not be used for the sending of unsolicited commercial email (as such term is defined in the CAN-SPAM Act of 2003 (the “Act”) and any rules adopted under such Act – sometimes called “spam”).
Customer will comply with all laws and regulations applicable to bulk or commercial email, as well as other electronic communications, when using the Services, including all local or national laws applicable to the regions where Customer has business operations or where the recipients of their electronic communications are located.
All emails sent from our Service must also comply with the US CAN SPAM Act of 2003, which includes:
- The “From”, “To”, and “Reply-To” information must be accurate and identify the person or business who initiated the message
- The Subject line must not be deceptive
- Emails must include a valid postal address for the sender
- Emails must include a clear and easy to use unsubscribe mechanism
Our terms of service require that all email be permission-based, that is, your recipients must have opted-in to receive your emails. Customers as a best practice, and to maintain compliance with international marketing laws, should retain the consent that they receive from their recipients. Consent should be freely given and clear that the email address will be used for marketing emails.
Our terms of service prohibit the use of third party email lists. This includes any lists that are purchased or rented.
Access and Use
Customer will use the Service only in way that will not damage or interfere with ClickDimensions provision of the Services to its customers generally. Customer is responsible for maintaining the security of its access to and use of the Services and will promptly notify ClickDimensions of any unauthorized access or use of which it becomes aware.
Customer is responsible for compliance with all privacy and data protection laws applicable to its location and operations. Customer will not provide ClickDimensions access to or upload or send through the Services any sensitive personal information, including social security numbers, passport or visa numbers, driver’s license numbers, taxpayer or employee ID, financial account or payment card information, passwords, medical or health records or information reflecting an individual’s medical treatment or the payment or provisioning of such treatment.
Any Customer use of the Services that results in bounces, spam complaints, or abuse complaints in excess of industry norms, is the cause of repeated IP blacklistings, or has evidence of purchased list use may have their account suspended in order for ClickDimensions to maintain the integrity of services. ClickDimensions reserves the right to suspend an account until the customer has resolved the situation. Repeated violations will result in account termination.
Recipients of emails sent using the Services are encouraged to report suspected violation of this Policy by forwarding a copy of the received email or other electronic communication to email@example.com.
